These Pre-Order Terms and Conditions (“Terms”) govern the placing of pre-orders ("Pre-Order") with AKiTiO (“we”, “ us”, or “AKiTiO”) for our storage products and other accessories ("Products"). Please read these Terms carefully before submitting your Pre-Order of any AKiTiO Products. By submitting your Pre-Order, you agree to be legally bound by these terms.
1. Pre-Order Reservation
When placing a Pre-Order for AKiTiO Products, you will be required to provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. AKiTiO shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information. You acknowledge and agree that AKiTiO may decline or delay reservations to avoid oversubscription or as it deems appropriate, provided that we will make efforts to inform you within two (2) weeks of our receipt of your Pre-Order, and that you will be entitled to a full refund of the purchase Price.
2. Payment
You will be charged the full Price of the Products at the time of placing the Pre-Order. If AKiTiO is unable to commence shipping the Products on or before the one-year anniversary of your placing the Pre-Order, AKiTiO shall process a full refund to you. Your placing of a preorder constitutes your express agreement to AKiTiO of charging the full Price of the Products at such time.
3. Priority
AKiTiO will build Products according to the order in which the Pre-Order is received. This position does not imply receiving a particular number associated with your Products. If you cancel or forfeit your reservation in accordance with the terms of this Agreement, your position will be taken by the next person on the Product reservation list. Notwithstanding the foregoing, you acknowledge and agree that we may need to build and use Products for a variety of purposes, such as in-house and third-party testing, evaluation, and display prior to fulfilling Product reservations. Furthermore, we may in our discretion prior to fulfilling Product reservations offer for sale to the public (for instance, by auctioning off) a limited number of Products. Please consult our website or our newsletter for more information about such events.
4. Delivery Schedule
Although we will make efforts to begin delivering Products as soon as reasonably practicable, you understand and agree that there may be delays. An estimated time of delivery (ETD) is only an estimate, is subject to change, and AKiTiO does not represent or warrant that it will be able to ship the Product by the estimated date. As a result, in the event that a delay arises and the estimated shipment and/or release of the product is not met, AKiTiO is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. We will provide you periodical updates with respect to such delivery schedule. If for any reason you decide that you do not wish to continue to wait for your Product, you may cancel your reservation as provided for in Section 6 below.
5. Price
The purchase price ("Price") does not include taxes and other government charges, which are your responsibility. If the Price drops after you have pre-ordered, we will refund you the difference. If the Price goes up, your order is secure at the low Price. The Pre-Order Price is valid from the moment you place the Pre-Order right up to 10 days after you receive the item. 6. Cancellation
You or AKiTiO may cancel this reservation by terminating the Pre-Order at any time for any or no reason prior to our notice to you that your Product is ready for delivery. If you do so prior to our notice of delivery, you will obtain a refund of the purchase Price without interest. If AKiTiO cancels your reservation you will receive a full refund of the purchase Price without interest (and you will not pay any processing fee).
7. LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES WILL AKITIO BE HELD LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT. IN THE EVENT AKITIO IS HELD LIABLE FOR ANY DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY WILL BE THE FULL REFUND OF YOUR PURCHASE PRICE WITHOUT INTEREST.
8. Terms and Conditions of Sale
The purchase of the Products is subject to additional terms and conditions provided by AKiTiO, including in respect of any software included in the Products or intellectual property embodied in the Products or data collected by the Products. The current Terms and Conditions of Sale can be found in the footer of the checkout page and are subject to change without notice. Your purchase of the Product will be subject to these terms and conditions and the refund policy
9. Age and Residency
You acknowledge that you are at least 18 years old, are a resident of the Unites States, and will take delivery of your Product in the United States. You acknowledge and agree that AKiTiO will initially focus its service efforts on certain geographical areas, and may expand to other areas as the company grows.
10. Customer Information
We will use any information that we may collect about you only in accordance with our privacy policy.
11. DISCLAIMER.
AKITIO DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE PROTOTYPE PRODUCT DISPLAYED BY AKITIO WHETHER BEFORE OR AFTER YOU HAVE PLACED THE PRE-ORDER. YOU UNDERSTAND AND AGREE THAT THE PRODUCT, ITS DESIGN AND TECHNICAL FEATURES ARE CURRENTLY UNDER DEVELOPMENT AND THAT THE PRODUCT THAT MAY BE AVAILABLE FOR PURCHASE BY YOU MAY BE MATERIALLY DIFFERENTLY FROM THE PROTOTYPE PRODUCT. IF FOR ANY REASON YOU ARE UNHAPPY WITH THE FINAL VERSION OF THE PRODUCT, YOUR SOLE AND EXCLUSIVE REMEDY WILL BE TO CANCEL YOUR PRE-ORDER AS DESCRIBED IN SECTION 6 ABOVE.
12. Changes to the Terms
AKiTiO reserves the right to change any of the terms for any or no reason. We will provide notice of any material changes and, if you are unhappy with such changes, your sole and exclusive remedy will be to cancel your reservation as described in Section 6 above.
13. Miscellaneous Provisions
These Terms constitutes the entire agreement between the parties pertaining to its subject matter and it supersedes all prior agreements, representations and understandings of the parties. This Agreement shall be governed by and shall be construed in accordance with the laws of the State of California. The venue for any actions relating to the subject matter or enforcement of this Agreement shall be in the Orange County, the place were this Agreement was entered and is to be performed. You may not assign this Agreement or any of the rights granted to you hereunder.

AKiTiO, Inc. ("AKiTiO") and its associates maintain this website (the "Website") and its contributions to Partner Sites (as defined below, and collectively with the Website, the "Sites") as a service to its customers and partners.
By using the Sites, you agree to comply with and be bound by the following terms and conditions (the "Agreement"), which we may change at any time by posting notice on the Website. AKiTiO authorizes you to view, download, and print the Sites Content subject to the following conditions: (i) you may only download and print the Sites Content in limited quantities as required to evaluate whether the goods and services of AKiTiO are appropriate for your use; (ii) you many not use any automated process or software program to view, download, print or otherwise use Sites Content; (iii) you may not use any of the Sites Content for the purpose of soliciting, for any service or product, companies that have information included in the Sites Content; (iv) you may not modify the Sites Content; (v) any displays or print outs of the Sites Content must be marked "© AKiTiO 2018. Your Indemnity of AKiTiO and its Partners; Termination of Use
You agree to indemnify and hold AKiTiO and its Partners harmless from all causes of action, claims and allegations (whether threatened or pending), costs, fees, charges, and expenses (including reasonable attorneys' and professionals' fees), judgments, damages, losses, and liabilities arising from or relating to the breach or alleged breach of your duties or obligations under this Agreement or your use of the Sites or Sites Content. For any indemnified matter, AKiTiO and its Partners will have full control of the response thereto and the defense thereof, including, without limitation, any agreement relating to the settlement thereof, and you will cooperate with AKiTiO and its Partners in such matter.
AKiTiO and any of its Partners may, at their option, terminate any person or entity's access to any or all of the Sites upon any breach of the terms and conditions of this Agreement.
Privacy Policy
AKiTiO is concerned about user privacy and operates the Sites under the Privacy Policy. We urge you to read this policy now and, because the policy is updated from time to time, later at your convenience.
Applicable Law and Jurisdiction
The Sites (excluding links) are controlled by AKiTiO and operated by AKiTiO from its offices in and around Taipei, Taiwan. Although AKiTiO has made no effort to publish the Sites elsewhere, because the Sites are published on the World Wide Web it is accessible in other countries. As each of these places has laws that may differ from those of Taiwan and from each other, and as you and AKiTiO both benefit from establishing a predictable legal environment in which to operate, use or otherwise exploit the Sites, by using the Sites you and AKiTiO agree that all matters arising from or relating to the use and operation of the Sites will be governed by the substantive laws of the Republic of China, without regard to its conflicts of laws principles. As used in this Agreement, "including" means "including but not limited to". The captions of this Agreement have been inserted solely for convenience of reference, in no way define or limit the scope or substance of any provision of this Agreement, and will not be considered in interpreting this Agreement. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, then this Agreement will remain in full force and effect and will be reformed to be valid and enforceable while reflecting the intent of the parties to the greatest extent permitted by law. Except as otherwise expressly provided herein, this Agreement sets forth the entire agreement between you and AKiTiO regarding its subject matter, and supersedes all prior promises, agreements or representations, whether written or oral, regarding such subject matter.

AKiTiO will take reasonable steps to protect user privacy consistent with the guidelines set forth in this policy and the applicable laws.
Information Collected
We collect information as necessary to enable us to identify you and respond to your requests for our products and services, to provide and improve them, and to send you information and support from time to time. When you use these services on our website, you may be asked to submit information such as name, email address, address, phone number, your firmware version, and areas of interest. We may also ask you where you have purchased our products, and for other information that will help us understand more about your needs or help us process your requests for information.
We use all personal information in accordance with this policy. Our information collection and use practices are described in more detail below:
- Help Desk Support: If you use our help desk, you may be asked for personal information such as name and email address as well as product name, firmware version and other information related to your computer and your network environment to help us determine what the technical issues are and how best to help you resolve them.
- Product Registration: Registration information may include personal information such as name and email address and other information related to our products such as model name, serial number and proof of purchase.
- Warranty Services: If you would like to return a product for repair under warranty, you may be asked for personal information such as name, address, phone number and other information related to our products including model name, serial number and proof of purchase. Submitting an RMA application will also require you to have a registered member account in order to submit a ticket on our help desk.
- Newsletter: When you subscribe to receive newsletters from AKiTiO, we will ask you for your email address to enable us to process your request and to send you information regarding our products and services.
How do we use this information?
The personal data collected through these services such as name and email address are used solely by AKiTiO for the purpose of communicating personally with you. The additional information you send us is used primarily to answer your questions but this information is also stored in our system for future references, if you contact us again and for our team to troubleshoot and improve our products and services.
Can I view and delete this information?
If you have a registered account, you can login to our website in the Support section and view the data you have previously submitted in the User Menu. To delete your information, some of the data can be deleted using the web interface but some information can only be deleted by our staff members.
- Help Desk Ticket: The tickets can be viewed online after login in the Tickets menu. To delete one or all of your tickets from our system, please submit a new ticket or reply to an existing ticket and let us know which information you would like to have deleted.
- Product Registration: Any products you have registered can be viewed and deleted after login in the User Menu under Product Registration List.
- RMA Application: Any RMA applications you have submitted can be viewed, edited and deleted after login in the User Menu under RMA Submissions.
- Newsletter: To remove your email address from our newsletter list, please click on the "Unsubscribe" link in any of the newsletter messages you have received from us. As an alternative, if you have a registered account on this website, you can login and then unsubscribe from within the User Menu under Newsletter Subscription.
- Member Account: You can edit your profile after login in the User Menu under My Details. To completely delete your account, we will have to also remove all relevant information that you have previously submitted. If you would like to do that, either let us know through our help desk or email us at This email address is being protected from spambots. You need JavaScript enabled to view it.
